1. Introduction
This manual is published in terms of section 51 of PAIA. It explains what records Phezulu Academy (“the Academy”) holds, how a person may request access to those records, and how the Academy processes personal information in terms of POPIA.

3. The Information Regulator’s guide on how to use PAIA
The Information Regulator has compiled a guide, in each official language, on how to use PAIA and POPIA. It is available from the Regulator at inforegulator.org.za, by email at inforeg@justice.gov.za, or at its offices: JD House, 27 Stiemens Street, Braamfontein, Johannesburg, 2001.
4. Records available without a request
The following are available to anyone without a formal PAIA request: the content of this website, including the course catalogue, prices, contact details and this manual; our privacy policy; marketing material and course brochures; and, on request, our SETA and QCTO accreditation details and B-BBEE certificate.
5. Records held in terms of other legislation
The Academy keeps records as required by, among others, the Companies Act 71 of 2008; the Income Tax Act 58 of 1962 and Value-Added Tax Act 89 of 1991; the Skills Development Act 97 of 1998 and Skills Development Levies Act 9 of 1999; the National Qualifications Framework Act 67 of 2008; the Basic Conditions of Employment Act 75 of 1997; the Labour Relations Act 66 of 1995; the Employment Equity Act 55 of 1998; the Occupational Health and Safety Act 85 of 1993; the Compensation for Occupational Injuries and Diseases Act 130 of 1993; the Unemployment Insurance Act 63 of 2001; the Broad-Based Black Economic Empowerment Act 53 of 2003; and POPIA. Access to such records is governed by the relevant Act.
6. Categories of records held
- Company records: founding documents, statutory registers, minutes and resolutions, tax and B-BBEE records.
- Financial records: accounting records, bank records, invoices, quotations, contracts with clients and suppliers.
- Training and learner records: enrolment and enquiry details, attendance registers, assessment and moderation records, certificates issued, learner achievements uploaded to SETA and QCTO systems, and records kept under our accreditation conditions.
- Client records: contact details, training agreements, correspondence, quotations and invoices.
- Personnel records: employment contracts, payroll, leave, disciplinary and performance records, facilitator, assessor and moderator registrations.
- Operational records: policies and procedures, health and safety records, insurance, IT and website records.
7. Processing of personal information (POPIA)
Purpose: to deliver and administer accredited training and assessments; to respond to enquiries and quotations; to comply with SETA, QCTO and statutory reporting; to manage employment; and to run the business.
Categories of data subjects and information: learners and enquirers (names, contact details, ID numbers where required for certification, qualifications and assessment results); client organisations and their representatives (contact and billing details); employees and contractors (personal, payroll and employment details); suppliers (contact and banking details).
Recipients: the relevant SETAs and the QCTO (learner achievements, as required by accreditation); our accountants and auditors; our IT and hosting providers, who process data on our behalf; and regulators or courts where the law requires.
Cross-border transfers: none, other than where a client is based outside South Africa and receives records about its own delegates.
Security: access to records is restricted to staff who need them; electronic records are held on password-protected systems with backups; paper records are kept in locked storage; the website is served over HTTPS.
8. How to request access to a record
- Complete the prescribed request form (Form 2, available from the Information Regulator’s website) and send it to the Information Officer at the address or email in section 2.
- State which record you require and the form of access you want, and give enough detail for us to identify the record. If you are asking on behalf of someone else, provide proof of your authority.
- If the request is for someone else’s personal information, or for a record held in the public interest, explain the right you are seeking to exercise or protect and why the record is needed for that purpose.
- Pay the prescribed request fee (currently R100 for a private body) when you submit the request. Access fees for searching, preparing and copying records are charged at the rates prescribed in the PAIA Regulations; a deposit may be requested for large requests.
We will decide on a request within 30 days of receiving it (extendable once by up to 30 days where the Act allows) and inform you of the outcome, and of your right to apply to a court or lodge a complaint with the Information Regulator if access is refused.
9. Grounds on which access may be refused
Access will be refused where PAIA requires or permits it — for example to protect the privacy of a third party, commercial information of a third party or of the Academy, confidential information, the safety of persons and property, records privileged from production in legal proceedings, or research information. Where only part of a record must be refused, the rest will be provided.

This manual is available on our website, at our offices during business hours, and from the Information Regulator. It will be updated when the information in it changes.
